Indonesian Minister Violates Agreement over Newmont
Finance Minister Agus Martowardojo violates an agreement with the House in his decision to purchase seven percent of PT Newmont Nusa Tenggara (NNT)’s share, a legislator said.
The Commission XI deputy chairman said the minister has committed the violation through purchasing seven percent of NNT’s shares while it had not yet been decided in a meeting between the DPR and the minister.
He said that the finance minister and his commission had agreed to discuss the government’s plan to buy NNT’S share after the completion of the House recess period early in May.
"If the government has decided to purchase the shares (of NNT, it means that the minister has violated the agreement with the House," Harry said.
Harry said his commission would question the minister’s decision. Director General for State Assets Hadiyanto has said in a press release that the government through the Government Investment Center (PIP) has decided to acquire seven percent of NNT stake.
He said that the finance minister had sent a letter on April 14, 2011 to NNT’s president director to confirm its plan to buy seven percent the firm’s divestment shares. Currently, the PIP was finalizing the term and conditions for the purchase of Newmont’s shares.
Harry who is a cadre of the Golkar Party faction said that the government should not make a unilateral decision if it was related to the use of the state money.
"All uses of the state money must be approved by the House. The question is that whether the funds that would be used to acquire NNT’s shares had been included in the state budget," he said.
He said that if the funds for the purchase of the shares had not yet been allocated in the state budget while the minister had decided to use one, it meant that the minister had violated the law on state budget and that was very dangerous.
